IMPORTANT NOTICE TO ALL USERS
Please read these Terms of Service and Privacy Policy carefully before registering, creating an account, or accessing the Cravo platform. By clicking "I Agree," checking the signup agreement box, or accessing any service provided by Cravo, you agree to be bound by all terms, conditions, disclaimers, and data collection practices outlined herein.
TERMS OF SERVICE (TOS)
1. Introduction and Platform Architecture
1.1 Agreement Scope
This Terms of Service agreement ("Agreement") constitutes a legally binding contract between you ("Customer", "User", "Merchant Partner", or "Courier") and Cravo Ecosystem ("Cravo", "Platform", "We", "Us", or "Our"). This Agreement governs your access to and use of the Cravo web portal, mobile software applications, API interfaces, and AI-driven personalized food delivery management services.
1.2 Multi-Sided Marketplace Ecosystem
Cravo operates an AI-driven, hyper-personalized multi-sided food ecosystem that connects four distinct operational user groups:
- Customers: Individuals browsing food options, setting fitness/budget goals, receiving AI meal recommendations, placing orders, and utilizing dietary tracking.
- Restaurant Partners (Merchants): Commercial kitchens and food vendors displaying dynamic menus, processing incoming orders, managing food preparation, and creating promotional offers.
- Delivery Couriers: Independent delivery personnel fulfilling order dispatches via real-time spatial navigation and route optimization.
- System Administrators: Authorized system personnel overseeing platform security, database records, order escrows, role-based access control (FR-23), and system health.
2. Account Registration, Authentication, and Security
2.1 Eligibility
You must be at least 18 years of age (or the lawful legal age in your jurisdiction) to register an account on Cravo. By creating an account, you represent and warrant that you possess full legal capacity to enter into this contract.
2.2 User Credentials and JWT Security
Upon registration (FR-01), user passwords are encrypted using industry-standard bcrypt hashing algorithms. Account sessions are managed via stateless JSON Web Tokens (JWT) using HTTPS encryption (COMP-API-01). You are strictly responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. You must immediately notify Cravo of any unauthorized session breach or security compromise.
3. Intermediary Status and Multi-Sided Role Disclaimers
CRITICAL LEGAL DISCLAIMER - INTERMEDIARY PLATFORM:
Cravo is an AI-driven technology platform that facilitates connections between Customers, independent Restaurant Partners, and independent Delivery Couriers. Cravo is NOT a food preparation facility, restaurant, caterer, or employer of delivery drivers. Cravo explicitly disclaims all liability regarding food safety, food quality, cooking hygiene, ingredient mislabeling, preparation delay, or physical delivery handling.
3.1 Merchant Responsibilities
All food preparation, menu accuracy, dietary labeling, calorie content calculations, ingredient disclosures, allergen handling, and sanitary kitchen conditions are the sole legal responsibility of the respective Restaurant Partner fulfilling the order (FR-12).
3.2 Courier Status
Delivery Couriers operate as independent logistics service providers. Cravo does not employ drivers directly, nor does Cravo control vehicle operations, road conduct, or traffic compliance.
4. Artificial Intelligence (AI) Features and Health/Nutritional Disclaimers
NON-MEDICAL AND NON-NUTRITIONAL ADVICE DISCLAIMER:
All AI-generated meal recommendations (COMP-AI-02), mood-based suggestions, daily calorie remaining calculations (COMP-BIO-03), and AI food advisor chat responses (via OpenAI API / LLM instrumentation) are provided strictly for informational, educational, and convenience purposes only.
4.1 Not a Licensed Healthcare Provider
Cravo, its AI Engine, and its automated algorithms do NOT provide medical diagnosis, clinical nutrition counseling, treatment, or formal dietary prescriptions. The AI Engine processes text prompts and user-configured profile parameters using machine learning models to generate statistical suggestions.
4.2 Severe Food Allergies and Medical Restrictions
You are solely responsible for verifying ingredients and allergen information directly with the fulfilling Restaurant Partner. Cravo cannot guarantee that AI-recommended menu items are free from cross-contamination, peanuts, gluten, dairy, seafood, or other severe allergens. If you suffer from medical conditions (e.g., anaphylaxis, celiac disease, diabetes, renal conditions), you must manually confirm all dish details prior to ordering (FR-06).
4.3 AI Chatbot Interactions
Interactions with the integrated AI Dietary Assistant (chatWithAI) are automated via external LLM endpoints. Suggestions made by the AI Assistant do not bind Cravo or Restaurant Partners legally or financially.
5. Fitness API Integration (Google Fit / Apple Health)
5.1 Optional Integration and OAuth 2.0 Consent
Cravo offers integration with external fitness tracking frameworks (such as the Google Fit REST API / Apple Health / Health Connect) to synchronize daily energy expenditure and active caloric metrics (FR-21). Synchronization occurs ONLY after explicit user opt-in and OAuth 2.0 authorization (FitnessConnected == TRUE).
5.2 Accuracy Disclaimer
Cravo is not responsible for inaccurate activity telemetry, step tracking errors, or corrupted health metrics reported by third-party fitness applications or wearable devices. You may disconnect fitness API synchronization at any time through your Profile Settings page.
6. Financial Management, Monthly Budgeting, and Cart Constraints
6.1 Algorithmic Fiscal Tools
Cravo includes a monthly food budget tracking feature (MonthlyBudget) designed to prevent impulse spending and promote financial discipline (FR-17).
6.2 Self-Managed Tool
The budget feature is an automated spending log based on orders placed within the Cravo platform. It does not constitute banking advice, credit management, or financial planning. Cravo accepts no liability for overall personal spending, overdraft fees, or external card charges.
7. Ordering, Pricing, Payment Processing, and Escrows
7.1 Currency and Pricing
All prices, delivery fees, and order totals are displayed and processed in United Arab Emirates Dirham (AED). Prices are set by Restaurant Partners and may include statutory UAE Value Added Tax (VAT) where applicable.
7.2 Payment Gateways and Tokenization
Digital payments are processed securely via third-party PCI-DSS compliant payment gateways (Stripe API - COMP-PAY-04). Cravo does NOT store raw credit card numbers, CVVs, or full payment credentials on local MySQL database servers.
7.3 Order Placements and Rejections
Placing an order constitutes an offer to purchase. An order is finalized only when the Restaurant Partner accepts the dispatch request. Restaurants reserve the right to decline orders due to kitchen overload or item unavailability.
7.4 Cancellations and Refunds
Customers may cancel an order (FR-20) only prior to kitchen acceptance. Once a restaurant begins food preparation ("Preparing" status), cancellations are non-refundable. Refund disputes for incorrect or damaged items are evaluated on a case-by-case basis by System Administrators.
8. Logistics, Live GPS Delivery Tracking, and Dispatches
8.1 Automated Dispatch
Order dispatches to Delivery Couriers are automated using spatial algorithms (COMP-LOG-05) based on restaurant coordinates and courier availability.
8.2 Route Optimization and Delivery Estimates
Delivery timeframes displayed on the platform (FR-10) are estimates calculated using mapping services (Google Maps Platform API - FR-22). Cravo is not liable for delivery delays caused by traffic congestion, adverse weather, accidents, or kitchen preparation delays.
9. User Conduct, System Integrity, and Prohibited Activities
Users agree NOT to:
- Automate queries, reverse-engineer, or scrape AI recommendation endpoints or system databases.
- Submit fraudulent payment tokens or initiate unwarranted payment chargebacks.
- Manipulate rating/review systems or submit false delivery claims.
- Harass, threaten, or abuse delivery couriers, restaurant personnel, or support agents.
- Attempt role escalation or bypass role-based security access rules (FR-23).
10. Limitation of Liability and Indemnification
MAXIMUM LEGAL PROTECTION AND INDEMNITY:
To the maximum extent permitted by applicable UAE laws, Cravo, its student developers, academic supervisors, and officers shall NOT be liable for any indirect, incidental, consequential, special, or punitive damages arising from food consumption, physical injury, allergic reactions, AI suggestion errors, delivery delays, financial spending overruns, or third-party API service outages (e.g., OpenAI, Stripe, Google Maps).
You agree to indemnify, defend, and hold harmless Cravo and its development team from any third-party claims, liabilities, damages, or costs (including legal fees) arising from your breach of these Terms, misuse of the platform, or violation of food safety/allergen guidelines.
11. Governing Law and Dispute Resolution
These Terms of Service are governed by and construed in accordance with the federal laws of the United Arab Emirates and the local laws applicable in the Emirate of Dubai. Any dispute, claim, or controversy arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Dubai, UAE.
